I'm moving my pivot point but scaling isn't changing
I want to scale just the bottom part, but the whole thing is scaling, no matter what.
I know I could easily just convert to edible poly and highlight the bottom polygons and scale it, but not only do I want it to be a perfect bottom half scaling, I also want to know for future reference.
I appreciate your time,

not sure it will be useful since im not an expert, but that might give you some ideas.
since you are working in 3Ds Max and im using Maya i will try to give you a solution on Maya
and try to see if that makes any resonable solution for you (i've heared that these 2 softwares pretty the same).
about moving the pivot - in maya all you have to do is press the Insert key once and that opens you a free way to move your pivot, or you can hold the D key and move it like that,
if you are trying to move it symmetric while holding the D key also hold X key or if you pressed inseart just hold the X key while moving the pivot.
about scaling - wont it be easier just to grab all the bottom vertexies and scale them? or the edges? as far as i know its pretty the same, unless you are trying to make an animation.
hope that will give you a direction to fix that.

You don't say how exactly you want to scale it, ie like a gentle curve out or a sharp straight out like a table top sits on a base. In Max, you can select the bottom vertices and use Soft Selection to pull out a gentle scale. It works better if you have more geometry to spread the selection over.
For sharp work only on the lower ring of polys, select the polys and extrude out along Local Normals.
