I presume Deepshade has surrendered the thread, so now let's hijack it :-)

These problems happen for a very particular reason. It's because the people asking for files and stuff, are not real decision makers with authority or legal knowledge.
A creative director or account manager in an ad agency isn't compelled to know the copyright law that governs these situations. All they want, is to do their jobs without fuss.
What makes me furious is that they call it "unthinkable", when you say I can't (or don't want to) give the 3D files.

My way around it is to explain that a computer file is "software" and within the file there's a "method" of making things, which consists of my "know-how". Non are for sale. Rather, "my time is for hire". We sell services, not products. We license the use of software, not sell it.

Usually, after all this, they say "ok we understand... will you give us the files now, or not?"
Funny enough, any clients that paid and got the files, couldn't use them, for one reason or another...

Go figure...

HA! thats been my experience too, they have the tools but clients dont have the artistry to get the same result...Thats why they hired you!

Your explanation of "your buying my time, not my techniques" is a good respectful response.
