Animation layers copying keyframes by default

Hi I'm having an issue with Maya 2013 animation layers. I am using a standard HIK rig, when I create a new animation layer with a control curve instead of getting a clean layer without any key frames as expected. Maya seems to add all of the keyframes from the base animation layer to the new layer. I can still see all of the keys on the base layer but they have turned a dark burgundy colour. Is there some strange setting I could have enabled by mistake?
