Layer order always get scrambled

This is one thing that has really been bugging the sanity out of me.
Everytime I open my scene, or create a new layer (or delete one) my entire layer list gets scrambled and the layers get ordered chronologically. This is really annoying because I want to keep certain layers at he top all the time (LOD-layers, NURBS, builders, etc).

It feels like a bug, but I guess it could just as well be some setting. But whatever is causing it I want it GONE. Is there anyone else here who've stumbled across this nuissance?

there's 2 options in the layer editor for this, show Alphabetically or show chronologically

Yea and the sorting text is greyed out.
