when a fix is in the 'BackBurner' category, is the BackBurner program patched or is it just max that is patched or both?

It really depends on the nature of the fix. It can mean both or only one or the other. Any ones you have specific questions about?

Not to be called "smart ass".. but shouldn't it be called "2013 defect list"... since the problems are fixed.... or "2014 fix list"... (smart ass mode off)

we run backburner manager on our main server machine (win server 2012) which does not have and will never have max installed so my concern is that any patches for max that also fix parts of backburner are never going to be applied to our main server machine which will no doubt cause problems between the backburner manager and backburner servers at their different patch levels

Generally as long as the render nodes are kept current as is BB you would not see any issues. Any updates just on the 3ds Max side though should generally never "break" the existing running BB. Of course if you update the BB you should update every machine.

Sorry to revive this thread, but are you sure this is a fix list? Or just a list of bugs you're aware of. We're trying to upgrade to BB 2014 and are suffering from bugs in that list, specifically:

MAXX-9504 
Priority and Progress lost if the Manager has a program error
