Lofting a wave (includes file)

HI
I have created multiple splines that have a morpher modifier to replicate the sequence of a breaking wave.
I am having a problem lofting the multiple shape splines.
On the resulting loft the instanced shapes are rotated by 90 degrees resulting in 2 dimensional geometry.
I have successfully created the loft profile that i wanted (included as selection set "working set") but have since changed the splines. My current set that i am trying to loft is named selection set "not working".
I have never really understood lofting and why it moves path / shapes around.
I have tried reset xforms on both path and shape.
max 2012 64 file
any help appreciated.

have just noted that the gizmos on the working set (path and shape) have y as up whereas in the non working set they have z pointing up.
Should i just adjust pivot on the non working elements and rotate to match?...
will try that.
