how do you benchmark a graphics card and its performance in apps like 3dsmax?

SPECapc is a good start:

well is there some kind of 3dsmax based viewport/opengl test?

SPECapc benchmark IS for 3ds max viewport. I think it's pretty good.
Other than that there's Maxbench - the scenes in the "Benchmarks" folder on the second disc. Look at 3dluvr techzone for more info. These scenes are the most commonly used benchmarks on review sites.

load a szene and play back the animation
then you can record the fps with fraps (www.fraps.com) or any similar application
this works for all opengl apps

The best benchmark to test with, is your own. If you just bought a new card, pull up one of your more hefty cg scenes. Test it in wireframe/shaded/lit. Check it at various resolutions, color depths, maximized, and quad viewports.
Compare its score with the previous cards. Information is personalized to your own specific needs. Solution found, happy all around. (Unless you find out the new stuff is actually slower...which can happen).

It would be actually nice to have a database of results that you could compare your results with. You may not even know that something is wrong with your viewport speed until you see a similar machine that gets twice better FPS.
