I'm getting a weird smoothing problem here. Help me out?

After smooth:

Why does the top have that weird overlap thing?

My guess would be because you have a 14-sided poly there. Connect the points so it's mostly quads.

Or you could have a double face.

(In 3ds Max you sometimes accidently have double faces, resulting in all sorts of odd effects, much like the one you are showing.

You should work with quads too, the subdivision is much nicer than with non quads.

The ear is definitely not finished yet, that's why there's a lot of non-quad polygons right now.

I just want to know what might be causing the problem in the circled area.

Well, your 14-sided poly is being meshsmoothed over it's own edges. Does it make sense? It does to me. See how all the edges go towards a point that is outside your original polygon?

The stuff that's sticking out are the original edges.

Doh! Yeah, I see now. I had ASSUMED that the smooth would automatically split those sides in the most common, logical way, but I guess I need to guide it more with more specific splits.
