Oooooold news. While it's reasonably well known that the GPL has not been challenged in court before this it's simply an attempt by SCO to be allowed to legally incorporate Linux code into their failing HOS UNIX.

If the GPL isn't valid they shouldn't have agreed to it in the first place... not to mention that they themselves have been selling a version of Linux under the GPL... Anything in it is covered under the GPL and they don't have a case because they agreed to it. If they hadn't managed to hold off the court date for so long they probably would have already been ordered out of the court for wasting everyone's time. =P
