Mental images announced that iray will be included with the release of mental ray 3.8, they also said there would no cost to existing customers. Does this mean as Maya users we will be able to download mental ray 3.8 and iray for free, or does that only pertain to those who have a mental Ray standalone license? I'm not sure how new versions of mental Ray are usually handeled? Anyone know?

It will be incorporated (loosely, and with a brutal execution and interface inside Maya, like every other release of MR) into 2011, most likely, or possibly a service pack to 2010. I don't think MI releases updates to Maya's plug-in directly, but relies on Autodesk to help make things work.
