if your using the surface modifyer then if you create your own splines they must create shapes that have three or four sides, or the surface wont see them. also the vertexs need to be welded together, in the case where they cross, they need to occupy the same co-ordinated, select both and fuse. then it should work.
incidently, if you are making a surface by just adding the edit mesh modiyer on the top of it, the spline needs to be closed, so all vertexes need to be welded. Just click the spline sub onbject and it should tel you whether its closed or not.
check the manual too, coz there is a great tutorial on spline and surface, called patch modelling i think.

With the surface modifier, you don't acutally have to weld the verts together, they just need to be positioned closely together. There is a setting in the modifier that lets you adjust how close they need to be. If I recall correctly. Can save a little time... although, I prefer welding verts just to get a more refined mesh.

for me, the most simple way of reliably setting up the spline is tourn on 'vertex snap'. all your intersections will be perfect!:)
