OK, a couple of questions related to rigging for games. I have been asked to rig a character with bones as if it were to be used in a game. I was told that I could not surpass 25 bones. My question is. does the end effector bone that Max creates after right clicking to end the creation of the bones count, since it will not actually affect any geometry? Or does this still slow things down in the game engine because it must still recognize that it is there? This is extremely important for my foot set up as I can not figure out how to do toe rotation without having that last effector bone at the end of the chain. I was trained originally to use LightWave so I am a 3DS newbie. If any one could help me with some set up tips or any other info, as far as the bone count it would be much appreciated. Thanks in advance..

You should be able to use as many bones as you like. Usually when you export your character, it will only be viewing the bones that are used to manipulate the skin. I would say that you are safe to add as many as you would like to drive the animation, but I would check with your TD and find out for sure.
