how do I get volume fade under water with refraction?

I made amay aocean and stick a object going in to the water. Wellthen I create a volume primative cube under hte surface of the ware and set it color to a dark blue almost black color. I render it and it looks great and the my object appears to fade off into the depths. Well hmm I dont see any refraction well I found that under raytrace option and check it on. and re-rendered ok I now have refractions but now my folume for under hte water is not rendering. what gives and how doe I get around it. There has to be something that can be done here.

never mind it works you just can't ahve the transparency up all the way or it breaks.
