CGTalk - Error Message about creating new layers?!

i was just bout to model a woman i got the ref for tha otehr day n wen i try n create layers this message appears

"Error: Not allowed to set attribute 'currentDisplayLayer' to that value. No display layer has number '3'."

please can someone help, layerless n00b !
