I have tracked some footage with voodoo tracker and imported it into 3ds max. I have aminated a simple biped in my garden but when it walks past the bench it is not hidden. How do i create masks to hide it.

Do it in post.
Though it is doable in 3dsMax I wouldn't suggest it. Create a plane, convert to emesh or ePoly, add as much vertices as you need to cover the shape of the bench, apply a Matte/shadow material and place between biped and camera. You might need to adjust the shape framewise.

I will certainly give this a go, for future puposes i'd like to do it post as you say. I am using voodoo atm, i do have boujou but i don't know how to use it and its very slow to solve the camera. Do you know of anyway voodoo can do it. ?

You need to rotoscope(roto for short) that bench and use a compositing package to holdout the cg char...
There are lots of places to do this..but if you have aftereffects you can do it all in there. . .
shake would be better, but I realize not everyone has it...
