Is there a way that I can render a scene in Max with a transparent layer with out a background. I know Lightwave has a photoshop layer for export. Does Max have that capability?

As far as I know there isn't a psd format output in Max. :annoyed: But you can render tiff or tga, open the file in PS->select alpha channel and CNTRL+j. (When you render on a black background you can use Layer->matting->remove black matting)
