How did you choose to download it? File-->Save As?
When I downloaded it (I bought it yesterday), the button labelled "Mac" worked and launched the download within Safari. Not sure about the evaluation version, but it sounds as if you downloaded the page that contained the link rather than the file itself.

Well I download the evaluation version, I click on the icon that says MAC, and I have a 38.3MB file call index.aspx and its trying to open it with Final Cut Pro

Try right clicking and using save as to save the file. (control click).
Or try a different browser. :)
Cheers.

The size of the file sounds right.
Try renaming the file to Modo.dmg and then see if you can open it.
