itīs probably just (another (http://www.cgtalk.com/showthread.php?t=113179)) bug. it happens to me also. i think itīs some problem with the opengl zbuffer drawing in the viewports. iīm using opengl because directx9c with the latests drivers from nvidia are crashing max and im not in the mood to downgrade my graphic drivers. try changing to another display driver.
and another easier solution is to use POINT instead of dummy. point with a box does not have this problem.

Ya this is just a driver issue, don't feel to bad though, my Max works perfectly but Maya on my machine is a mess with the graphics drives. I can't see the rotate gizmo, clusters the points on the move gizmo and several other things when in the ortho views and some times in the persective view. I tell you this just incase you think the grass is greener on the other side. Let me tell you... it isn't.

I remember a couple animators at my workplace having this same problem with the old MAX bones. Old bones were helper objects too. The solution was to switch from Heidi to Direct3D/OpenGL.
Check and make sure you're not in Heidi mode(Customize/Preferences/Viewports/Choose Driver)
If you're in D3D/OGL then I don't know what to do :)

Same problem but the other way round on mine. Dummies always get drawn in front of other objects, but I find it hard to visualise where they lie in 3D space. Luckily point helpers don't have that problem so I can just switch to those. You can make points look like dummies by turning on their box mode and turn off the default cross. There's also an option to always draw them on top if you like.
This is with an ATI Radeon 9600 in Direct X mode.
