An anonymous reader writes "Suicidegirls (a not safe for work adult community) posted a nasty letter (http://suicidegirls.com/boards/The+Site/55715/) they received from Nintendo demanding they remove a member's page (http://suicidegirls.com/members/RuneLateralus/) on their site because the member listed Metroid and Zelda as their favorite video games."

...eh? Somehow I'm sensing a poorly conceived prank in all of this...

wow, that's really lame...maybe cgtalk will get sued tooo if we use sexually explicit words whilst also naming Nintendo products.

boobies . mario . ass.

i could understand nintendo being upset if the site had pics of women copulating with mario....but its just some CGer talking about his fav video games in his profile. he also mentions GTA and Halo, but you don't see rockstar or bungie/microsoft suing.

really weak.

Really does seem like stretching things a bit thin..really does seem like a prank, but then it's probably the sort of thing that's stupid enough to be real, by that token..sheesh.

Ron Jeremy dressed as Mario for a magazine photo shoot? No problem. Some random profile on an adult site out of millions that mentions Nintendo in a positive light? Ixnay.

Why can't they hit on the sites that show cartoons of mario having sex with disney characters and horses? (I don't recall seeing one in particular, but I have no doubt they're out there. Freakin' internet.)

P.S. Now the pic with the girl wearing the NES controllers in the letter thread or the two girls kissing while playing N64 is what I'd call positive association.

The audacity of Sean complaining about being threatened with legal action and touting the evils of lawyers is astounding.

If you all only knew what lies under the pretty surface of alt-porn...

The audacity of Sean complaining about being threatened with legal action and touting the evils of lawyers is astounding.Sure, SG has been pretty aggro about protecting their own IP, but in the cases I can recall it was reasonably justified..there have been some pretty blatant ripoffs..but then maybe I missed some other incidents.

I think the Nintendo thing is just plain stupid, it's hardly some kind of "IP suit karmic payback"..though it does seem like the kind of thing someone who felt that SG was overly litigious would send to them as a gag to make some kind of dumb point.

P.S. for erilaz - boobies!

Lets just say an analogy would be highend3d threatening CGTalk over the fact that they were a CG oriented site that featured forums and unique, valuable content.

Its legal badgering in an effort to stamp out someone not as financially, or not percieved as financially equipped to fight a legal battle involving lawyers which cost a lot of money. Its a poor business practice IMHO.

I agree with what I've read elsewhere about this. This legal firm has convinced Nintendo to allow it to pursue the protection of Nintendo's IP and is trying to cash in and make its service appear valuable by attacking anyone it can that mentions the name of a Nintendo owned IP.

Actually, I'll correct myself.

Its a very successful business practice with a long history of allowing the bigger competitor to destroy the new comer.

I just find it morally reprehensible.

Nintendo apologizes to Suicide Girls!
Nintendo sent the email below to the good people at Suicide Girls. Background <A href="http://www.boingboing.net/2004/10/27/nintendo_lawyergram_.html">here and here (http://www.boingboing.net/2004/10/27/nintendo_to_sue_suic.html).

Hello,

We would like to apologize to you and to those who frequent the suicidegirls.com website for inadvertently contacting you about a fan posting on the website.

We know that many of our fans are old enough to make their own choice about what they want to view on the Internet. We value the support of our fans and we respect their decisions. The letter was sent as part of an ongoing Nintendo program to aggressively protect our younger consumers from the hundreds of sexually-explicit sites each year that use Nintendo properties to attract children. We are proud of our efforts in this area. Unfortunately, the site posting identified in our letter was targeted by mistake.

As a gesture of goodwill, we would like to offer you (and RuneLateralus) a free Nintendo video game system and game of your choice. (...)

In addition, we would appreciate it if you could provide us with contact information for RuneLateralus, or have him contact us directly, so that we may apologize to him. We would be glad to send him a game and system of his choice through you as well, since we do not have his contact information.

Sincerely,
Christie Hamilton

Penny-arcade decided to take a Light hearted crack at this little oversight by Nintendo.

http://penny-arcade.com/view.php3?date=2004-10-29&res=l

On one end I can see that Nintendo wants to protect the integredy of its products. But on the other end I realy think they need to grow up. The gamers who played Metroid and Zelda from the very begining are all grown up now. And we still get enjoyment out of the series. As much as nintendo has made strides to make there games more mature, they fail to come to gripes that there still are alot of zelda, metroid, and mario fans that are well over 20 now and they should at least respect there right to firmly say that they are fans of the series. Myself included.

In other news, suicide threatens suicidegirls for misusing his name to make their slutfest somehow sound 'cool' to the average Joe.

Nice to see it end that way, and to see NOA apologizing.

It's always good too when Penny Arcade jumps on the subject!

very strange how nintendo would find that site, then find that exact profile with the supposedly inapropriate use of nintendos game names... like damn they should send nintendo to look for Bin laden since they're that good.

Was that first message sent by nintendo automated? and if so what the hell kinda fancy computers tracking do they got?

Its seems pretty stupid to me that they would apologize for an automated message by throwing in a gamecube. thats just asking for people to attempt to be wrongly accused..
