First, let me start by saying, it's a great start.

But, I'm a bit confused... What are you using 3DS Max? Maya?
As to 'nicer pants'. I'm not too sure what you mean. As in textures and how it looks? or in Geometry/Modelling wise? Cloth modelling as in cloth simulations? Would be helpful if you gave more details on how you are working.

For staters, change the pants shader/material to a Grey Lambert, this will kill off the highlights so it less looks like blue spandex and more like grey jogging sweats, if that is what your looking for... As for modelling, jogging sweats are baggy, supposed to help accumulate sweat. Unless, the sweats are tight fitting... :)

So model more foldings by drapping it over the shoes and areas where cloth catches the skin...

Otherwise......uh... yeah. :D

Maya it is then! :D

What you can do, from what I see in your model, is create more edges around the pelvis area and the knees, grab a ring of edges and scale them up and down them uniform for every other ring of edges to create a folds. Also using the artisan tool, you can move the CV's in the negetive Y axis to give it a more of an overlapping. Not sure, if what I explained can help. But hope it does. :D
