Critterslayer 09-20-2004, 05:14 PM I see the 3ds max 6 commercial version on ebay very cheap now and then. The auctions I've been to say that is it a legal version and unregistered and all. But what is discreets point of view, and is buying a copy on ebay completely legal? I thought I heard somewhere that software like this cannot be resold.

If people want to sell on a copy of max they need to do it through discreet, who have a dedicated department who issue all the relevant paper work for that sort of thing.

as far as i know you cannot legally resell max unless you are an authorized resller, licences can be transfered maybe in extreme circumstances eg. death - liquidation of business ( neither garantee that discreet will allow the transfer) discreet will not pass out authorization to such copies of max nor will they allow upgrades. but best off to check with discreet personally.

licenses can be transfered Officially, they can't according to clause 1 of the License. However, I did sell my copy of MAX 3.1 recently with the full approval of Discreet who did transfer over the license to the new owner. They do have a standard form for just this purpose...but you have to be very, very persistent !
liquidation of business No, under the terms of the license if a business owning a license goes into into liquidation then the license is permanently cancelled and cannot be transferred.
Buying a copy of eBay is almost certainly a bad idea unless you can somehow get confirmation from Discreet first that it is OK and they will more than likely request that eBay take down the auction.

man that really sucks, if they've already gotten their money for a copy of max x, they why do they give a flip what you do with it as long as you arent burning copies for other people??? unbelieveable.
