View Full Version : Marvel Sues Disney
kilikili 07-17-2004, 06:05 AM What they said:
"Marvel Enterprises has sued the Walt Disney Co. and ABC Family (formerly Fox Family) for at least $16 million, which it claims it is owed on the cartoons it licensed to Fox Family, which Disney acquired in 2001, reports VARIETY. As part of the suit filed July 15, 2004 in L.A. Superior Court, Marvel argues that Disney improperly accounted for profits on animated series THE INCREDIBLE HULK, X-MEN AND SPIDER-MAN and failed to promote the shows. In the complaint, Disney claims the toons lose money, but will not provide proper accounting.
In addition, Marvel also claims that Disney's purchase of Fox Family for $5.2 billion has left no money to develop the Marvel properties; that it improperly continued the sweetheart deals put in place by Fox; and that it buried Marvel's shows choosing to promote its own properties. As well, Marvel says that Disney will not allow Marvel to audit records on Disney's release of the SPIDER-MAN series on DVD, which coincided with the release of Columbia's SPIDER-MAN theatrical film."

So Marvel must take Disney's word for it? I'm not a legal expert, so I can only give my honest opinion. But isn't Disney required to provide a report of some kind? For their books as well as Marvels? :surprised
For the time being, I'm on Marvel's side.

HULK SMASH MOUSE!!!..
Toons don't make money, ya right. The mechandizing alone bring in millions, with the top characters of Marvel ( X-Men and Spiderman) hats off to Stan Lee . But with disney bad sense and not spending on development/created freedom on artists, animators, story writers and just want to make repeat mistakes in thier animation. No wonder why they are not making money in animation. And why Disney animators gone onto Pixar and Dreamworks or have gone independent with smaller studios.

You're assuming Fox/Disney got the merchandising rights and not just broadcast rights.

Sucks to be Disney, it smells like something aweful when Disney can't give numbers to prove they were loosing dough. I guess it goes to show lying and cheating occurs in the bigger businesses entities.

Haven't some of the creators at Marvel had similar beefs with Marvel about getting their fair cut? Guys like the late Jack "The King" Kirby--even Stan Lee, I believe. It may be a case of 'what goes around comes around." Anyway, there is a reason some people refer to money as "the almighty dollar." I'ts all most corporations care about, not people, not ethics --just money.

Sadly, even the Disney characters are pissed. A class action suit for institutionalized sexual harassment has been brought against Disney by Cinderella, Snow White, Sleeping Beauty, Pocahontas, Belle, Ariel, and Minnie. They claim Disney ignored their complaints over the years that Gaston, Donald, and three of the Seven Dwarfs regularly solicited the women for sexual favors during House of Mouse filming.
Sad, really.

What disney need to do it release The "Spiderman" and The "X-Men" Series from the early 90's on DVD. I know they won't lose money from that, I know alot of people who are waiting for that.

Shhhhh... You hear that? *thump thump*
That's the sound of Walt Disney turning over in his grave.
First they pull an ugly one on Pixar (God bless them)
and now Marvel comics!!! Disney is taking more enemies than it can take...
Did you guys know that in a few years, Disney will lose the copyrights of Mickey Mouse and other Disney long time characters according to the US copyrights law. One can only have rights over something for 50 years...
Disney is going down!!!

Disney is going down!!!That date has come and gone a couple of times - and each time Disney has successfully bri... er, "lobbied" congress to get copyright protection law changed. Mickey was originated in something like 1932, so he's way past 50.

Company suing company is nothing new. You would be surprise at the number of lawsuits out there. They are all about getting a bigger piece of the pie. I also wouldn’t feel sorry for Marvel, I’m sure they also had their share of stepping on the little guys.

Marvel should've sued Disney for everything it had, y'know? And put Disney out of its misery! ;)
It's official the movie and cartoon studio started by the gentle [kid-lover] we know as Walt is going to Hell! Down here with me and my vicious Imps!

You also rarely describe a man who snowballed a one man operation into a multi-million dollar, multi-national corporation as "gentle"

sounds to me like marvel is accusing disney of buying fox kids just to shut down the marvel shows, by not promoting them and letting them die... but not before trying to cash in on the success of the spiderman and (to a lesser extent) the hulk feature films.
another black eye for disney.

This theory may seem a little far-reaching, but Disney does have multiple cable networks dedicated to its own kid's programming plus the kid's shows it has for ABC.
Granted, none of them are any good anymore and just try to capitalize on their IP. Seeing the cartoon shows for characters based on those from the Pixar films is sad enough!

YES! bring back gummi bears, and talespin and darkwing duck. gargoyles, ducktales and gooftroop... those were the good 'ol days.
i don't even know what they have on there anymore... kim possible and the proud family are the only two i can think of, and they looked decent enough. but other than those two shows i don't think disney has anything worth watching anymore anyways. they don't even have t.g.i.f. anymore do they? with step by step and the dinosaurs or family matters, i used to love those shows as a kid.
