The warning came as the Glen Cove, New York-based company reported a net loss of $25.4 million for the fiscal fourth quarter ended March 31.

Acclaim, which publishes such games as "Combat Elite" and "Alias," needs new cash to replace a financing agreement with GMAC Commercial Finance that expires on Aug. 4. It said it has signed a letter of intent with a different lender to borrow up to $30 million but the deal has not yet been completed.

"Failure to obtain a new banking facility would materially adversely affect the company's operations and liquidity and the company could be forced to cease operations or seek bankruptcy protection," it said.

Acclaim said it is already in default on the 16 percent convertible notes that it sold last year. The company believes it can get a waiver from note holders and is currently in discussions"

CG in general is fine. It may be that some sectors in the industry may be struggling or on their way out. As with most things in life, changes come. Some things end and other things begin. Nothing new here. Although, I have to wonder sometimes if some companies are really in tune with their marketplace, that all important factor that keeps them in existence.

This is hardly news. Ack!lame has been teetering on the edge of oblivion since 1997.

Well They made shadowman which i liked, they also make Xtreme G which i thought sucked, and they made Turok which i loved the 1st and 2nd ones. then they ruined that with turok evolutions,

To be honest they havent done much good recently, and they shut down Acclaim:Teesside about 4 years ago, which was one of the better ones from what ive been told, and most of the team left to other companies. To the loss of Acclaim.

Both licenses have been lost for the same reason - alleged non-payment ofroyalties due - and while the Turok franchise has been effectively dead inthe water anyway since the commercially disastrous Turok: Evolution twoyears ago, the loss of the baseball license will affect one of Acclaim'sbiggest titles, All-Star Baseball. Without the license from the Major League Baseball Player's Association,Acclaim will no longer be able to use real player names and likenesses inits games; a crippling blow for the All-Star Baseball franchise, which hasbeen one of the few commercial successes to the company's name in recentyears. Acclaim claims that it has actually met its royalty obligations to the MLBPAand to certain key players, but the dispute continues, and has been ongoingsince May of this year, according to the 10-K filing which Acclaim submittedto the Securities and Exchange Commission at the end of last week. As for Turok, that franchise belongs to Classic Media, a company which holdsthe rights to numerous media properties, and which notified Acclaim in Junethat it was terminating the publisher's right to use the license due tonon-payment of royalties. Again, no solution to this dispute has been found, with Acclaim apparentlyin negotiations to find an amicable way out of it - although given the lowvalue that the license holds after the last game, it's questionable whetherthe company will be prepared to invest much effort in reclaiming thefranchise. Despite the low value of the Turok license, however, it is still a blow toAcclaim's image as a company to lose it in this way; especially coming onlymonths after another of the publisher's successful titles, the Burnoutseries, was moved over to Electronic Arts by developer Criterion. Following the news of the company's poor full-year results, possible creditdifficulties and the loss of these key licenses, Acclaim's stock took abattering on the NASDAQ market - with the company's share price down some 22per cent to $0.26 at time of going to press, although earlier in the day ithit a 52-week low at just $0.24.

Allegedly: Acclaim have been in a financial hole for a year at least...someone said something about the Baulders Gate sequel slippage accounting for their hurt, but i dunno, they have never been the most professional publishers in the first place, some very dodgy working practices...seems like someone hasnt been watching the pennies properley either.

They wont be missed by me.
