This error caused, i think, with your version of 3dsmax incompatible on WinXP..............I remeber you that the better Operating System for max is WinNT or 2000 ^_^
Another Tips:
If Max doesn't open your model or scene, make new project and merge all from damaged file.........almost time it works ^_^

thanx Daxx, merging was part of the solution, I deleted a mesh vertex points and it left the actual box primitive, so pretty much an empty primitive, I then started the new mesh and this old "invisible" mind you primitive kept giving the error message, so I moved the mesh outta the way and selected the invisible primitive, deleted and bam it worked. Go figure :) merging the file allowed me to see that there was another box in the scene ;)
